Terms of Service

These Terms of Service ("Terms") govern your access to and use of Jallarhorn™ ("the Service"), a product of Trellis Digital Services LLC ("Trellis", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Jallarhorn is an infrastructure-monitoring product distributed as a single download per host with a web dashboard, a REST API, and a set of sensor plugins. The Service includes the hosted components at jallarhorn.com and its subdomains (including but not limited to app.jallarhorn.com, api.jallarhorn.com, docs.jallarhorn.com, and status.jallarhorn.com), as well as self-hosted installations of the Jallarhorn binaries licensed to you.

2. Accounts

Accounts on hosted Jallarhorn are invite-only at tenant creation. Once a tenant is provisioned, the initial administrator may invite additional users with scoped roles. You are responsible for: keeping your account credentials confidential, maintaining the security of any API keys you generate, and all activity that occurs under your account. You must be at least 18 years old or the age of majority in your jurisdiction to register.

3. Plans and Pricing

Jallarhorn is offered in tiered plans — Free, Office, Business, and Enterprise — as described on the pricing page. Tier ceilings (maximum monitored devices) are enforced by the license server. If you exceed your tier ceiling, the Service will reject new device adoptions while continuing to monitor existing devices; no silent data loss occurs. Upgrading a tier is a self-service action in the billing portal.

4. Acceptable Use

You agree that you will not:

  • Use Jallarhorn to monitor systems you do not own or do not have written permission to monitor.
  • Use Jallarhorn to originate, amplify, or coordinate attacks against any system, network, or person.
  • Use Jallarhorn to bypass authentication, authorization, or rate-limiting controls on third-party services.
  • Resell, sublicense, or re-brand the Service without a written Enterprise or MSP agreement.
  • Reverse-engineer the billing, licensing, or tenant-isolation subsystems.
  • Upload unlawful, infringing, or malicious content to the Service.

We reserve the right to suspend or terminate accounts that violate this section, with notice where practical.

5. Service Level

Uptime commitments by tier:

  • Free and Office: best-effort. No contractual uptime commitment.
  • Business: 99.5% monthly uptime target. Service credits per the Business SLA Addendum on request.
  • Enterprise: custom SLA negotiated in the order form, including uptime credits and escalation contacts.
  • Self-hosted: no uptime commitment from Trellis; you operate the software on your own infrastructure.

6. Data Accuracy

Monitoring data is best-effort. Jallarhorn polls, scrapes, and receives pushed metrics; it does not guarantee the underlying system is healthy, nor that every failure is detected. Jallarhorn is a signal tool, not a guarantee. Do not rely on the absence of an Jallarhorn alert as proof that a system is operating correctly. Validate critical production systems with independent checks.

7. Payment, Refunds, and Cancellation

Paid plans are billed monthly through our payment processor. Monthly plans: charged on the subscription anniversary until cancelled. Annual plans: charged on the annual anniversary; annual savings are equivalent to two months free. You may cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period. We offer a 30-day no-questions refund on monthly plans and pro-rata refunds on annual plans for the unused portion. See the refund policy for specifics.

8. Intellectual Property

Jallarhorn™ is an unregistered trademark of Trellis Digital Services LLC. The Jallarhorn name, logo, and marketing materials are our property. You retain ownership of your monitoring configuration, metric data, and any custom sensors or scripts you author. Jallarhorn includes open-source components (listed in our SPDX SBOM on each release) which remain under their respective licenses; your use of those components is governed by their licenses.

9. Confidentiality

Each party agrees to protect the other's confidential information with at least the same care it uses for its own confidential information, and not less than reasonable care. Your monitoring configuration, metric data, and tenant metadata are your confidential information. Our pricing beyond the published tiers, internal architecture, and non-public roadmap are our confidential information.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE FROM UNAUTHORIZED ACCESS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRELLIS'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE FEES YOU PAID TO TRELLIS FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL TRELLIS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold Trellis harmless from any third-party claim arising out of your use of the Service in violation of these Terms, your violation of applicable law, or your infringement of a third party's rights. Trellis will promptly notify you of any such claim and cooperate in your defense, at your expense.

13. Termination

You may terminate your account at any time from the billing portal. We may terminate or suspend your account on notice for material breach of these Terms or for non-payment. On termination, your access to the hosted Service ends; we will retain your account data for 90 days per the Privacy Policy to allow recovery, and then delete it.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email to account administrators at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you may cancel your subscription before the effective date and request a pro-rata refund.

15. Governing Law

These Terms are governed by the laws of the State of Montana, USA, where Trellis Digital Services LLC is organized, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Montana, and you consent to personal jurisdiction there.
